Il y aurait eu masturbation mutuelle et fellation.<\/strong><\/p>\n<p>Le pr\u00eatre a ni\u00e9 qu&#8217;il y ait un rapport oral et a reconnu ces autres rapports sexuels. Il n&#8217;avait cependant pas \u00e0 r\u00e9pondre devant le tribunal de ces autres actes sexuels puisque la chambre du conseil de la Cour d&#8217;appel avait d\u00e9cid\u00e9 d&#8217;abandonner ces charges vu qu&#8217;il y a prescription p\u00e9nale.<\/p>\n<p>Les deux parties avaient un t\u00e9moignage diff\u00e9rent sur la fa\u00e7on dont ce rapprochement est arriv\u00e9. Le pr\u00eatre affirmait que l&#8217;adolescent l&#8217;avait provoqu\u00e9 sexuellement, \u00aballum\u00e9\u00bb.<\/p>\n<p>Les juges retiennent l\u2019\u00e9l\u00e9ment mat\u00e9riel de viol, <strong>\u00e0 savoir l\u2019acte de p\u00e9n\u00e9tration sexuelle constitu\u00e9 en l\u2019esp\u00e8ce par l\u2019acte de fellation, mais eu \u00e9gard \u00e0 la date de la commission de l\u2019infraction, ils sont amen\u00e9s \u00e0 appliquer l\u2019article 375 du code p\u00e9nal<\/strong> dans sa version ant\u00e9rieure \u00e0 la loi du 16 juillet 2011.<\/p>\n<p>Or, ce texte fixait l\u2019\u00e2ge pour pouvoir donner son consentement libre \u00e0 un acte de p\u00e9n\u00e9tration sexuelle \u00e0 l\u2019\u00e2ge de 14 ans accomplis. <strong>Il en d\u00e9coule qu\u2019\u00e0 partir de l\u2019\u00e2ge de 14 ans la preuve de l\u2019absence de consentement devait \u00eatre rapport\u00e9e par le minist\u00e8re public. \u00a0\u00a0<\/strong><\/p>\n<p>Dans leur d\u00e9cision de ce jour, les juges ont constat\u00e9 qu\u2019une telle preuve n\u2019avait pas \u00e9t\u00e9 rapport\u00e9e.<\/p>\n<h4>Le parquet a fait appel contre cette d\u00e9cision.<\/h4>\n<p>Source : <a href=\"http:\/\/www.wort.lu\/fr\/luxembourg\/accuse-de-viol-sur-mineur-l-ancien-cure-de-belair-acquitte-le-parquet-fait-appel-5858fbb453590682caf167a7\" target=\"_blank\">wort.lu <\/a><\/p>","protected":false},"excerpt":{"rendered":"<p>L&#8217;ancien cur\u00e9 de Belair, qui devait r\u00e9pondre d&#8217;accusation de viol sur mineur devant le tribunal, a \u00e9t\u00e9 acquitt\u00e9 mardi matin.
